Channel Partner Code of Conduct
The VIAVI Channel Partner Code of Conduct outlines the principles of no bribery, antitrust compliance, health and safety and environmental compliance, and many others that emphasize our expectations of partner integrity.
It is VIAVI policy to conduct business in compliance with all relevant export laws and regulations of the U.S. and to those of all other countries in which VIAVI and its subsidiaries operate.
VIAVI products are subject to the U.S. Export Administration Regulations (EAR) administered by the U.S. Department of Commerce, Bureau of Industry and Security (BIS). Diversion of VIAVI products contrary to U.S. law is prohibited.
VIAVI products and technology may not be exported or re-exported, directly or indirectly, to any country subject to general embargoes or comprehensive sanctions without prior written authorization from the U.S. government. Currently, these restricted countries are the Crimea Region of Ukraine, Cuba, Iran, North Korea, Sudan, and Syria. For the most updated information, please review the countries as listed under country group E:1 in Part 740, Supplement No. 1 of the EAR, and refer to the EAR part 746 for embargoes and other special controls.
VIAVI products and technology may not be exported or re-exported, directly or indirectly, to individuals or entities listed on any of the U.S. government lists as outlined on the BIS website. These lists currently include: Denied Persons List, Unverified List, Entity List, Specially Designated Nationals List, Debarred List, and Non-proliferation Sanctions.
National Security (NS)
Certain VIAVI products and technology are controlled for NS reasons and may require an export license from the U.S. government prior to export or re-export.
Please consult with your legal counsel on the export and re-export requirements for NS-controlled products.
Some VIAVI products and software contain encryption. These encrypted products have been reviewed by the U.S. government and qualify for license exception ENC 740.17 (a),(b)(1) or (b)(3) Unrestricted.
Please consult with your legal counsel on the export, re-export, and import requirements for encryption products for the U.S. and abroad.

VIAVI is committed to complying with the OECD Due Diligence Guidance for Responsible Supply Chains of Minerals from Conflict-Affected and High-Risk Areas, as well as the applicable requirements of Section 1502 of the Dodd-Frank Act, which aims to prevent the use of minerals that directly or indirectly finance or benefit armed groups in the Democratic Republic of the Congo (DRC) or in adjoining countries (conflict minerals).
VIAVI suppliers are required to ensure that smelters and refiners in their supply chain sourcing minerals from conflict-affected and high-risk areas are either compliant with the CFSI Conflict-Free Smelter Program assessment protocols or are actively working towards becoming compliant.

Slavery and Human Trafficking Statement
The California Transparency in Supply Chains Act of 2010 and the UK Modern Slavery Act of 2015 requires manufacturers and retailers to disclose information about their efforts to eliminate slavery and human trafficking from their supply chains.

Environment, Health, and Safety
Protecting the environment and maintaining the health and safety of our employees, customers, and communities are important to VIAVI. By integrating sound environmental, health, and safety-management practices into our business, we can offer technologically innovative products and services while conserving and enhancing resources for future generations.
To demonstrate our commitment to the highest standards of environmentally responsible conduct, VIAVI has adopted the standards of the Electronics Industry Citizenship Coalition’s (EICC) Code of Conduct. We believe that the industry-wide effort of the EICC is an efficient and effective way to integrate social, environmental, and ethical responsibilities into the supply chain, and are proud to announce that our recent audit shows VIAVI to be in compliance with the Code of Conduct.
We continue to make progress to become a greener organization in the areas of energy use, water consumption, and solid-waste minimization. Our facilities practice continual improvement through the principles of the ISO 14001 standard as well as conforming to the guidelines of the EICC Code of Conduct.
Energy Use Reduction
VIAVI is committed to researching and implementing energy efficiency measures at our sites all over the world in order to reduce our energy consumption and carbon footprint.
To reduce our water consumption, VIAVI partnered with Siemens Water Technologies to design a water-reclaim system at our Santa Rosa site to treat water and recycle water, saving 4 million gallons of water per year.

VIAVI is committed to compliance with all applicable laws and regulations controlling the use of hazardous substances in its products
Waste Electrical and Electronic Equipment (WEEE)
VIAVI has implemented a comprehensive program to comply with the WEEE Directive as it applies to its test equipment products. Two environmentally-friendly solutions are available for the disposal of customer Waste Electrical and Electronic Equipment (WEEE): Trade-in or Take-back.
NOTE: the Take-back program is available to VIAVI test equipment customers only in countries where the WEEE legislation applies. Recycling centers that require detailed product information about the products in the Take-back program should contact The VIAVI WEEE program manager.
The VIAVI Encore Certified Equipment program allows customers to trade-in certain old test equipment for credit against the purchase of new VIAVI equipment, VIAVI Encore certified pre-owned test equipment, or VIAVI PLUS Services. The traded-in equipment will be used by VIAVI for spares or refurbishment.
VIAVI has partnered with Recycling Network Europe to offer a free WEEE collection and recycling service to its Network and Service Enablement customers. WEEE is collected from the customer site and is then disposed of in accordance with national and European environmental legislation.
